PUBLIC DEFENDER
Councilmember Winnecke: Okay, Public Defender, line item 1303-1870-1303 Deputy Public Defender, I move that this line item be set in at zero, as with line item 1303-1900 FICA zero; and 1303-1910 PERF zero, for no appropriation.

Councilmember Sutton: So is this – I guess last week we talked about our hiring refreeze. Does this kind of go in line with what we had talked about even back last week?
Councilmember Winnecke: Yes, sir.
Councilmember Hoy: There is some money that can come back from the state on this, which makes it a little different to me and I know he needs – this is for juvenile, I believe, and he needs this position. But there will be some refund. I don’t think he’s able to –
President Raben: Steve is in the audience.
Steve Owens: Steve Owens, Public Defender’s Office. The need for the additional public defender juvenile (inaudible – microphone turned away from podium), one is to bring the caseload in the juvenile court within the public defender commission guidelines. That would be the main purpose. The second thing was, if we bring all four positions within the public defender commission guidelines, we will be eligible for a partial reimbursement of all four of the salaries in those positions, and right now we’re getting partial reimbursement of one salary. And we’re not going to be able to ever get to the compliance with the standard with the number of people we’ve got right now. The appropriation request basically is 40% of the salary for the balance of this year – we’ll fund the other 60% and if we can get to that stage where the commission standards are met, then we will be asking at the conclusion of 2003 that the commission reimburse us a portion of all four public defender salaries. That should result in a net increase in reimbursements for those four positions over what we’re now receiving for the one position. That is the purpose of the request for the appropriation.
President Raben: Steve, as it is now, I mean, there is not any cut and dried reimbursement on this position, on this requested juvenile position, though right? I mean, you have to then apply to qualify the four positions for reimbursement, right?
Steve Owens: As we’re doing it now, we have three public defenders. Two come under – we can get no reimbursement for those two, their caseloads are too high. The third public defender, we have been keeping their caseload within the set guidelines and we’re getting reimbursement for a percentage of their salary. But if we have this fourth, we spread the total cases out among the four, and then we’re eligible for reimbursement for a portion of all four of the salaries and benefits.
President Raben: And is that 60% or 40%?
Steve Owens: It’s always 40%. The only thing that increases over 40 is a capital case, and that’s not applicable down there.
President Raben: Councilman Bassemier?
Councilmember Bassemier: So what will it cost us if we approve this and all four of them are included? I mean, are we –
Steve Owens: Well, you’re funding three of the salaries out of the general fund this year now, and you’re going to get 40% reimbursement for roughly one of those salaries. If you approve this for 2003, the $6800 or whatever the appropriation request is, we’re going to get part of that $6800 back for this fourth position, plus we should be able to pick up some reimbursement for two of the public defenders that we’re not getting any reimbursement back –
Councilmember Bassemier: That’s what I’m saying, if we do get the reimbursement, it would lower that figure of $6,831, right?
Steve Owens: Of the $6800? Some of that is coming back to the general fund in the reimbursement.
Councilmember Bassemier: That’s what I’m getting at. Lloyd, are you still stuck on setting that in at zero?
Councilmember Winnecke: Yes.
Councilmember Bassemier: Okay, I was –
Councilmember Tornatta: Come next year, we’d almost get a free employee with the reimbursements.
Steve Owens: That will be the hope. I mean, I anticipate that at least for the balance of the 2003 - 2004 fiscal year, for the Indiana fiscal year, probably there’s not going to be any rationing of reimbursement. Probably towards the end of the fiscal year, the state fiscal year that is mid-next year, there’s probably going to be some pro-rationing (inaudible.) So will you get a free employee? Maybe and maybe not.
Councilmember Tornatta: I guess I’m looking next year, we put that in the budget for next year, we have four employees, we get 40% of all their salaries –
Steve Owens: You won’t get 40% of all their salaries, that’s the problem. Not everything in juvenile is reimbursable. We have a unique situation in this county and that is that only the delinquency portion of their salary can be reimbursed?
Councilmember Tornatta: And what would that be?
Steve Owens: That’s about 40% of each one of their salaries, their caseload. So you’re getting about 40% of 40% for the four.
Councilmember Bassemier: Could you repeat your caseload? They’re doing so many more than they’re really supposed to be doing? What was that –
President Raben: Steve, before you answer that, could you pull the mike closer to you just so we’re sure we’re picking it up on tape?
Steve Owens: Sure. Two of the public defenders down there right now are carrying roughly two times the number of cases that the commission approves. We have kept the third public defender within the commission standards because when we I came to this body last year and said that I needed a third one, the way we got the third one was, we keep this person within the standards and we get 40% of their salary back. We’re not going to be able to do that forever. We need to propose a plan to the commission that brings that whole group within compliance. Ultimately what will happen is the commission will ultimately say, if you can’t bring them all into compliance, we’re not going to reimburse any of them. The fourth public defender in juvenile court should allow us to bring all four within caseload compliance, which should increase somewhat the total reimbursable dollars for those four public defenders.
Councilmember Tornatta: Do you have to do this this month or can you get us some information on this issue for this year and for next year, what we’re looking at as far as what our payout would be possibly? Or what our reimbursables would be on all the salaries?
Steve Owens: You’ve asked me a couple of questions. One, do we have to do it this month? The answer to that question is no. The figure the appropriation request that we’ve made is figuring on having somebody starting on roughly July the 1st, okay? That’s how we calculated that. In terms of getting figures for this year, I’m not sure what figures you want. Caseload figures or salary figures?
Councilmember Tornatta: No, reimbursables for this year. What you would expect if all four go into compliance, what you expect to come back to us, and then for next year, if we had all four in compliance for the whole year, what the reimbursables would be.
Steve Owens: We can give you estimates.
Councilmember Tornatta: We can make a case with that.
Steve Owens: We can give you estimates if we have four for let’s say calendar year 2004, but what the potential reimbursement is going to be assuming everything stays the same?
Councilmember Tornatta: Correct.
Steve Owens: Yes, we can do that.
Councilmember Sutton: Steve, is the state totally caught up at this point on its reimbursements for our expenses that are eligible at this particular point in time?
Steve Owens: We have pending a claim that they are voting on today for 140 some odd thousand. I anticipate that’s going to be approved. We’ll probably receive that within the next 45 days. Are they totally caught up? Yes. I mean, they don’t owe us anything at this point. We probably will get full reimbursement for the first two fiscal quarters of 2003-2004, I would anticipate, given what I’m seeing from the state, that probably for the final two quarters, we will probably get pro-rated, but that’s kind of up in the air depending on how much each county files a claim for.
Councilmember Sutton: And when is the next time that the state will actually meet to make that decision about whether they’ll pro-rate it, whether they’ll reimburse us at the 40% level?
Steve Owens: They meet roughly every quarter. They do it on a quarter, so the quarter they’re voting on today, basically, is the first quarter of 2003.
Councilmember Sutton: Okay, so they’ve caught up substantially. I know they were behind last year.
Steve Owens: Right. And then this second quarter, they will actually have the meeting probably in August to make a determination of whether they’re approving the second quarter of 2003. They’re always going to run several months behind because of the way the commission holds the meetings. So we won’t know, for example, until August if they’re going to approve in full the second quarter request for reimbursement. It appears that they’re going to because of the way that the deposits are made to the fund. Those deposits actually come in on July 1st and December 31st, I believe it is.
Councilmember Sutton: Well, I think the question that Councilman Tornatta had about being able to see if we were in compliance, what that reimbursable amount would add up to, whether it would cover the cost of this position or part of this position. That would be helpful data for us.
Steve Owens: We can give you the general figures assuming everything stays the same as it is right now. And all we can do is make an estimate because we don’t control the number of cases that juvenile appoints.

Councilmember Winnecke: I will, given the request from Councilman Tornatta, I will withdraw my motion to set these in at zero and move to defer until we get the additional information from Mr. Owens.

REASSESSMENT/COUNTY ASSESSOR
Councilmember Winnecke: Okay, Mr. President, under Reassessment, appropriations, line item 2492-1090-1310 Hearing Officer, I move we set this in at $19,145; line item 2492-1090-1900 FICA, I move that it be set in at $1,465; line item 2492-1090-1910 PERF be set in at $1,053; line item 2492-1090-1920 Insurance in the amount of $2,200, for a total appropriation of $23,863, and I move that it be approved with the following condition: that if an existing employee is appointed to this position, the funds in that employees current salary line will be transferred into line 1090-1970 in Temporary Replacement and that a temporary employee be hired until the proposed hearing officer’s duties are completed. The hearing officer’s position that we’re creating would be created through this year only. And I make that in the form of a motion.
Councilmember Wortman: Second.
Councilmember Tornatta: Then make it again.

Councilmember Sutton: Let’s make sure we’re clear on that motion again. Why don’t you go back over that.
Councilmember Winnecke: Okay, you have the numbers, right?
Councilmember Sutton: Got the numbers, we just need some bullet points on that caveat.
Councilmember Winnecke: Okay, basically, the motion is that we create the additional hearing officer as we’ve discussed and that, assuming that this position is going to be filled by an existing employee, okay, that person moves in that position, that employee’s original line item be transferred to Temporary Replacement so that a temporary replacement can be filled for that position. So we are creating no permanent employees in this office, but we are creating a hearing officer for the balance of this year to help with the appeals for the reassessment.
Councilmember Tornatta: Okay, what about the PERF, FICA, Insurance? Would you provide that for a temporary employee?
Councilmember Winnecke: We currently don’t for temporary replacement.
Councilmember Tornatta: Okay, but you’re leaving that line item open?
President Raben: No, the temporary that he’s referring to is this person’s old position. So the funds that are in her current line item before she assumes this hearing officer’s position is where he’s stating that those funds be pulled from the old line item so a new full-time employee can’t move in to that spot. So we don’t end up with a new full-time employee.
Councilmember Tornatta: Alright.
Councilmember Sutton: Well, the one thing with that, now if this person for this hearing officer position is selected from the office, it’s an upgrade, say, in their present position. Come, well actually, the beginning of next year, are they to go back down to the original salary level and position grade that they had originally?
Councilmember Winnecke: That’s correct.
President Raben: Correct. And that’s the purpose with moving the old line’s funds into temporary replacement, so a person can’t be put in that position where we end up with, technically, what would be a new employee.
Councilmember Sutton: Is that the intent of the officeholder? I mean, she’s not here, but –
Councilmember Winnecke: Yes, and I talked to Ms. Musgrave a couple of times today, and she had a previous commitment and could not be here, but that is her intent.
Councilmember Tornatta: And my question also to follow up on that is going to be, are we going to need any other data entry help or any clerical help to go with this position because I haven’t seen that come across? And we’re essentially creating a new post, although we’re not , but are we going to ask for an additional person to help with data entry and such?
Tammy Elkins: I don’t believe so. Tammy Elkins, Chief Deputy for the County Assessor’s Office. With the addition of the hearing officer and putting another person in this, the temporary replacement, to do the data entry that that person was doing, we’re hoping at this time that will be sufficient for our office along with the extra help that we have. They’ve also been working on that.
Councilmember Tornatta: Okay, because I would – I mean, I’m okay – there’s more than one way to skin a cat and this will work, but I’d really, I don’t want to see this office back here asking for another employee to do data entry, you know, if they think they’ve got it figured out here.
Tammy Elkins: I personally can’t speak for Mrs. Musgrave, but as far as what I know right now, we don’t have any plans to ask for additional clerical help.
Councilmember Tornatta: Okay.
President Raben: And I have one quick comment before we vote on this. You know, we’ve taken the position, no new employees, and my personal opinion of this is that this is an emergency. That property tax collection is what makes our clock tick here, so this is, in effect, an emergency and I’m okay with it.
Tammy Elkins: Just an update, as of 2:00 this afternoon, we had 1,243 appeals. We have the last several days going on, so we expect to get quite a few in the last few days and we know a lot will probably be mailed on the 9th to meet the deadline. If you’re interested, we have a breakdown of the appeals in the individual townships. We only have the grand total on this sheet of 702 because, as you mentioned, we are logging those in. So take the difference of those two, that’s what we have to log in at this point. Are you interested in that sheet?
President Raben: Sure.
Councilmember Tornatta: And how many did we have last reassessment?
Rick Barter: 1,300 and change.
Councilmember Tornatta: Now, the only thing I’ll bring to the board is 1,300 and change was the last reassessment. That was the number of appeals. We really don’t know, am I correct, we don’t know the number of appeals that are going before PTABOA, because they’ll have to go to the townships first, so that might even be a lesser number than the number.
Tammy Elkins: And I understand it, they all go to the preliminary hearing with the township assessor. If they reach agreement, they still come back to our office just as a review and then they go in front of the PTABOA. So yes, the ones that the townships agree on, we’ll still have some paperwork to do on those, but very little compared to the ones that cannot be reached agreement at the township level.
Councilmember Tornatta: So we might not end up in as bad a shape on the appeals as what we once – was reported in the paper. Thank you.

REASSESSMENT/PTABOA
Councilmember Winnecke: Mr. President, I would move that the balance of our transfer requests including the late transfer request from the Commissioners be approved as presented.
Councilmember Hoy: Second.
Councilmember Tornatta: I have a question. I was never sure what the contractual services were on the PTABOA.
Councilmember Winnecke: I believe that was for attorneys. Mr. Barter or Tammy?
Councilmember Tornatta: At one point had we not done something with the attorney already?
Tammy Elkins: I believe that the contractual services would be used for the PTABOA attorney as well as any contractual services that we may need for appraisals that would be used in the appeal process. We have money in there now, but we just want to put this in to make it through the end of the year, transfer it.
Councilmember Tornatta: How much money do you have in there now? I don’t have that in front of me.
Tammy Elkins: I don’t think I do either.
