The Vanderburgh County Council met in session this 7th day of April, 2004 in room 301 of the Civic Center Complex. The meeting was called to order at 3:30 p.m. by County Council President Ed Bassemier.

Councilmember Tornatta: Just to tie into that for the families in the explosion and everybody around the explosion that happened is big as well, so...
President Bassemier: It has been a tragic weekend, it saddens all of us. Okay, and one other thing, Mr. Raben, finance chairman, would you come up here a minute please? Now it’s your turn. This is kind of late coming, but we all want to kind of give you a little plaque here for a job well done last year as president. You kept us all in line and kept us all honest and great job. Councilmember Raben: Okay, thank you, Mr. President. I guess I was called to the front. I did want to echo a few of your comments on the death of Major Wallis. You know, one of the perks to sitting up here is the relationships and the people that you meet, not only here, but a lot of them in this room, and he was one that most of us will always cherish. And I think a pat on the back also should go out towards the Sheriff’s Department, the men and women that have worked beside him that is just something. The two days that I saw how tall and proud they stood, you know, for not only him but his friends and family, and I think they deserve a pat on the back

COOPERATIVE EXTENSION SERVICE
Councilmember Raben: Okay, Co-op Extension Services, Contractual Services in the amount of $1,210. I’ll move approval.
Councilmember Wortman: Second.
President Bassemier: I have a motion and a second. Any discussion? Mr. Sutton?
Councilmember Sutton: I had a question last week about this particular request and this discussion about this extra amount came up, oh, probably about three years ago and then again about five years ago on this amount. And there’s a formula that Purdue uses to decide how much a particular match may be. Now that doesn’t mean that we have to match that up fully up to that amount, but still, they will go ahead and compensate what that position is supposed to be compensated for. So the question I had last week was related to whether this was an amount that we had already committed to or whether this was an amount that in the past that Purdue had picked up the additional amount. And I guess as I understand, this amount would actually have been an amount that Purdue would have picked up and not the county would have picked up. So if we spend this, these are dollars that, like I said, actually that Purdue could actually allocate toward this rather than coming out of our dollars.
Councilmember Tornatta: They won’t. This will come out of their budget one way or the other.
Councilmember Sutton: Well, in the past that’s the way we have done this. In fact, its come up on several different occasions.
Councilmember Tornatta: I’m their liaison. I called and asked those same questions, but unfortunately, Purdue is setting a limit of what they are going to pay and that’s throughout all the extensions, and this is the number that we lack from the budgeted number that they set. And they’re behind our budget time. So we’re getting a number that we think is supposed to be set in and then the actual number comes from Purdue. So this is just short of what we budgeted.
Councilmember Raben: But to Royce’s point, I think it was brought up as recently as last August during our budget session.
Councilmember Tornatta: They’re on a different budget cycle, I think that’s what the whole problem is. Any problem that we’ve ever had with different operations has always been just because they’re trying to budget what they think the bar is going to be set and in this case, they set it too low.
Councilmember Sutton: Councilman Hoy, do you remember this discussion that we had about this? And I know its back a ways, but you were around back then, I believe, when we first began to kind of debate this and I think actually Bettye Lou Jerrel was actually on the Council when we first began discussions on this issue.
Councilmember Hoy: I don’t remember enough detail to comment. I know we had the discussions but its not – my computer isn’t bringing that up, I’m sorry.
Councilmember Sutton: We’ve had a few things pass by in the meantime.
Councilmember Hoy: Normally, I remember those kind of discussions, but I don’t remember the details.
Councilmember Sutton: Sandie, do you have any information that might be helpful in terms of shedding some light on this?

Councilmember Wortman: Mr. Chairman, I think Troy is right. They always submit their budget and then Purdue sometimes has to come up and match it and if they do, they do, and if they don’t, they don’t.
Councilmember Tornatta: Well, they submit what they think it’s going to be and Purdue puts out what they think its going to be for our budget. Then once Purdue gets kicked in and started, then they get the actual numbers and then that’s when they submit it to the 4-H extension.
Councilmember Wortman: I think that’s always been the procedure.
Councilmember Tornatta: And what they’ll have to do, they’ll have to take this out of one of their budget lines if we don’t supply it. We talked about that when we were in budget hearings, I do believe, because I go over their budget with them.
Councilmember Raben: This kind of goes back to at what point is enough, enough? How much can the local entities like ourselves pick up?
Councilmember Tornatta: I understand and that’s something a legislator has to have maybe some contact with the Purdue extension because they won’t –
Councilmember Raben: Mr. Sutton, I would consider amending my motion to defer this.
Councilmember Sutton: I think maybe we ought to if just to give ourselves ample time to really give consideration to this and I hate for us to not allocate the money and we need to or to allocate the money and we don’t have to. If that would be your pleasure, that would probably be the appropriate thing.

CCD/COMMISSIONERS
Councilmember Raben: Okay, CCD account 2031-1300-4230 Motor Vehicles in the amount of $125,000, I’ll move approval.

President Bassemier: I have a motion and I have a second by Mr. Hoy. Any discussion on this? Mr. Wortman?
Councilmember Wortman: I’d like to ask how this is going to affect the piggyback style on prices?
Councilmember Sutton: The what?
Councilmember Wortman: Like they always do it in the fall of the year with that other $125,000, and how will this here appropriation – will you do it now and get the same price for the vehicles or will we have to wait?
Eric Williams: Chief Deputy Eric Williams, Sheriff’s Office. We buy those on the back of the Indiana State Police’s QPA, which is good for the year. The problem we run into is because we have to have the brown and tan vehicles, they have a build date of May 16, that’s the last day that they’ll build those cars until next year, so the price is the same regardless of when we order them through the year.
Councilmember Wortman: I wanted to check that, thank you.
President Bassemier: Okay, anybody else?
Councilmember Sutton: And we’re getting how many vehicles, Chief Deputy?
Eric Williams: Right now the plan is, with the original allotment from CCD and then this, that should put us ten new vehicles in the fleet, which is what we have talked about for the last six or seven years now.
Councilmember Raben: If you recall, I’m trying to remember exactly how it was said, but I think last – in August for this fiscal year budget, there was a request for like 125 out of General Fund and 125 out of CCD, and we zeroed out the General Fund and said take it all out of CCD.
Eric Williams: That’s correct, and the Commissioners have been agreeable to that.
Councilmember Sutton: Well, and the good thing is we’ll get a steady flow of replacing the cars rather than trying to replace them all at one time.
Eric Williams: The system has worked very well.
Councilmember Wortman: We don’t want to give you too many cars with the price of gas now, so –
Eric Williams: That is the next issue that we’ll be facing here in short order.

SUPERIOR COURT SUPPLEMENTAL ADULT PROBATION
Councilmember Raben: Okay, Superior Court Supplemental Adult Probation, we’ve got several requests, 2620-1100-2620, 2620-1110-2620, 2620-1190-2620, 2620-1200-2620, 2620-1220-2620, 2620-1230-2620, 2620-1900, 2620-1910, for a total request of $15,144. I’ll move approval.

Councilmember Sutton: I know this is just maybe kind of a question that if, maybe if someone from Superior Court maybe could respond to, and I guess as we’re looking at this, what is mandated by the state –
President Bassemier: Judge, can you come forward please?
Councilmember Sutton: As is mandated by the state, and you guys don’t have any particular control on this, I don’t know if the relationships or the discussions you’ve had with other counties and how they are addressing this, because some of them, with their financial situations across the state, I would imagine this really puts a hardship on the number of counties –
Terry Dietsch: Yes, and it has for years. And we are caught between the minimum salary schedule by the judicial conference, and that was by virtue of legislation enacted by the state legislature. And we are caught between our own salary schedule here in Vanderburgh County with the various step raises and also the incremental percentage raises each year by the Council, and therefore, we have some people who are under the minimum, and some people who are over the minimum. And we’re going to have to reconcile those. To complicate the matter further, the anniversary date of when step raises kick in is different than the minimum salary schedule from the state as opposed to our own anniversary dates on step raises. If we have a person with a step raise in 2004 and that kicks in in fiscal 2005, January, if you have a step raise on the state portion, that kicks in on the anniversary date regardless of when it is. Ms. Deig and I discussed this originally and I think maybe Mr. Wortman, I’m not sure, and we discussed the possibility of well, what happens to the people who are over. And I think we each had the same initial reaction, well, those people simply won’t get a raise. Well, I thought about that, and a couple of things were called to my attention. I don’t think that you can treat people differently under our county step schedule or job study schedule than any other people in the county. These things eventually will work, I think, work themselves out. It’s just that we’re going to have to make this transition for fiscal 2005 and its going to cause Ms. Deig a lot of trouble and its going to cause us a lot of trouble and it’s going to cause the Auditor a lot of trouble. But yes, there was enabling legislation that allowed the judicial conference to establish those minimum wages and we have to comply with them. But, your initial question, what about the smaller counties? Well, there have been a couple of lawsuits and they were not going to pay and the Supreme Court, the last case in 1997 says yes, you are going to pay. And that’s why, the last time, the other week, last week when I presented this, I suggested that if we really needed to discuss this, I’m perfectly willing to discuss this with the Council and I’ll have all the data for you so that you can take a look at it and show you exactly where we are and what I think this means for fiscal 2005. Does that answer your question, Mr. Sutton?
Councilmember Hoy: Sounds like a mandate to me.
Terry Dietsch: It is what some people refer to as an unfunded mandate. Its legislation passed by the state legislature directing the judicial conference to establish minimum probation officer salaries that must be complied with by the various counties in the state. And that’s no different than unfunded mandates we get from the federal government all the time.
Councilmember Wortman: Mr. Chairman, I think Judge Dietsch commented that he’d like to meet to discuss this before the budget process.
Terry Dietsch: Yeah, I thought we had essentially agreed on that.
Councilmember Wortman: I think Mr. Winnecke and Mr. Raben and maybe Troy or Mr. Hoy might –
Terry Dietsch: Like I said, I’m perfectly happy to meet with all of you. We’ve done that on occasion but its so difficult to coordinate everyone’s schedule. But whatever you would like, I will do.
Councilmember Raben: Well, there’s probably not any need to meet. This takes care of the situation, it carries it forward from this day on, so –
Terry Dietsch: But I would like to meet with Ms. Deig certainly, and maybe you, Mr. Raben, to make certain we agree on the particulars of what’s going to happen during fiscal 2005, if we’re going to have things kick in and how that’s going to be handled.
Councilmember Winnecke: Yeah, that’s the real, the issue is really for 2005. This takes care of this year.
Councilmember Raben: But I think its clear that they’re paid their increase the first pay period after their anniversary date, right?
Terry Dietsch: Yeah, on the state schedule, right. It starts on their anniversary date. If their anniversary date say for ten years is March the 12th, that’s when it starts. Under our schedule, if their anniversary date is March the 12th, the raise kicks in the following January the 1st, I believe.
Councilmember Raben: Unless it falls January 1 though the 31st.
Terry Dietsch: Right. But see, when the legislation was enacted, I don’t know whether there was any discussion about what counties, if any, had a job study that involved step raises, I have no idea whether that was discussed.
Councilmember Wortman: I’d make a call and kind of confer with other counties and see what their procedures –
Terry Dietsch: But surely we are not the only county that has been the subject of a job study, I wouldn’t think.

President Bassemier: Amendment to the Salary Ordinance.
Councilmember Raben: Okay, first is the Sheriff’s Department, amend salary line 1050–0210 Investigative Transcriptionist, set the salary in at $31,288, current employee is a PAT IV, Step 4. Amend salary ordinance lines as follows: 1050-0020 Sergeant in the amount of $46,479; 1050-0021 Sergeant in the amount of $47,205; 1050-0024 Sergeant in the amount of $49,118; 1050-0030 Sergeant at $46,505; 1050-0031 Patrolman at $39,308; 1050-0098 Patrolman in the amount of $40,655. Under Jail, amend salary line 1051-1850 Union Overtime as previously adopted. Superior Court Supplemental Adult Probation, amend salary lines as follows 2620-1100 Probation Officer $11,016; 2620-1110 Probation Officer at $6,040; 2620-1190 Probation Officer at $3,866; 2620-1200 Probation Officer at $3,591; 2620-1220 Probation Officer in at $3,316; and 2620-1230 Probation Officer at $5,022. President Bassemier: Okay, the second item under old business, if you all remember on March 3rd, we all voted to send a letter to the Commissioner’s President, Catherine Fanello, to appear here at our County Council meeting, this April 7th meeting or have some rep, somebody or one of the Commissioners as a rep here in reference to that Waggoner, Irwin, Scheele contract. Is there anybody from the Commissioner’s office out there? We’ve got some questions we’d like to ask you.
Councilmember Tornatta: I was in contact with Commissioner Fanello and Commissioner Mosby. Commissioner Mosby has duties today with work. Unfortunately, it’s a part-time position, but Commissioner Fanello also has – its tax time and she’s knee deep in that. She said if you, as the President, would set up a time because I don’t think, Curt, you got in touch with them, did you?
