MAY 18, 2005


The Vanderburgh County Board of Commissioners met in special session this 18th day of May, 2005 at 12:00 p.m. in room 307 of the Civic Center Complex with President Suzanne Crouch presiding.


Call to Order


President Crouch: Good afternoon. Welcome to the Vanderburgh County special meeting of May 18th at noon.


Award of VC05-03-01:

Oak Hill Road-St. George Road Intersection Improvements


President Crouch: The purpose of this meeting is to award the bid for VC05-03-01, Oak Hill Road-St. George Road intersection improvement. We have with us our Assistant County Engineer who will make the engineer’s recommendation, Mr. Pat Seib.


Patrick Seib: Good afternoon. I would like to recommend awarding contract number VC05-03-01 to J.H. Rudolph. They were the low bidder on the project, in the amount of $734,717.80.


President Crouch: And, are we....oh, I guess, we need a motion.


Commissioner Musgrave: Move to approve the low bidder as recommended by the County Engineer’s deputy.


Commissioner Nix: Second.


President Crouch: All in favor?


All Commissioners: Aye.


President Crouch: So ordered. Thank you, Mr. Seib. Are we going to have a meeting or a briefing?


Commissioner Nix: We are going to have a pre-job meeting with the contractor and all the utilities involved. We haven’t set a date for that yet, but I’ll for you or Mr. Stoll to get back with us and we’ll have that before the job’s started.


President Crouch: Real soon?


Commissioner Nix: Yes, real soon.





Discussion of Items Commissioner Musgrave is Working On:

(A) Letter to Judges about Access to Courts Records to

Run Certain Infractions against County Employee Database

(B) Information on Obtaining Driving Records of County Employees

Who Have Permission to Operate County Vehicles


Commissioner Musgrave: Madam President, if that’s the last of the business here, I have a couple of items that I want to tell the Commissioners that I am going to be pursuing between now and our next meeting.


President Crouch: But, we won’t be taking action.


Commissioner Musgrave: We will not take any action, I just want to let you know that I’m going to pursue this. I’m going to have ready for your signature, if you so desire to do that, on Tuesday, a letter to the judges and the County Clerk asking to explore the possibility of access to their records. Now, the purpose of this would be to take our list of county employees and tie it in with their database of infractions, and we would have to work out between us with infractions. For example, we might not care if anybody got a divorce, but we might care if somebody was arrested for murder, a county employee. So, this database would check that automatically, and be designed to inform the Commissioners and the Auditor if such an event happened. So, I am going to work on that letter, and I’ll bring it to your attention on Tuesday. Then there is one other thing that I’m going to work on, I had contact this morning with the Deputy Sheriff , Eric Williams, what I would like for the Sheriff’s Department to do, if the attorney determines that there is no legality issue here, is take all the drivers of county owned vehicles, county employee, county owned vehicles, and run that against any available database to look for driving offenses. So, that we’re aware if there are any problems with any of our employees who operate our vehicles that we own. So, I’m working on those two things, I’ll bring it back to you.


Commissioner Nix: I was going to say, that may help with our insurance rates over time too. You may want to talk to our carrier, because I know that that does help when companies do that, so.


President Crouch: That will be, you’re talking about the Sheriff checking that against, not just our Vanderburgh County, but against other states?


Commissioner Musgrave: What he has told me is that he can check it against the entire state’s registry, Indiana’s registry for driving offenses. I asked if there was a national registry, and he said that the thing there is that states have to agree to cooperate and share those records , and that most states have not agreed to cooperate with Indiana. So, I’ll specifically want to know from him which states are cooperating with Indiana? What can we do about the rest of the states who don’t? How can we, for example, I asked him does Kentucky, Illinois, Ohio, and Michigan, do they cooperate with Indiana? He said, no. So, you know, I go to Kentucky all the time, I’ll bet county employees go to Kentucky sometimes too. So, I would like to find out how do we get that information? So, there are some things to work out there, and, hopefully, I’ll have some of this worked out by Tuesday, and I’ll report my progress.


President Crouch: In addition to doing a letter, could you have a conversation with the courts?


Commissioner Musgrave: Who would you recommend that I talk to over there?


President Crouch: I know that with the courts technology it seems to be that Judge Knight is the person in charge. So, that might be a good place to start.


Commissioner Musgrave: Now, sometimes I’m not fully aware of the oversight given by the courts to the Clerk. Or is it the Clerk and the Judge together? The Clerk alone with the advice of the judge? Or is that something that–


President Crouch: I would just–


Commissioner Musgrave: Work it out?
