The Vanderburgh County Board of Commissioners met in session this 20th day of March, 2007 at 3:30 p.m. in room 301 of the Civic Center Complex with President Cheryl Musgrave presiding.
Call to Order |
President Musgrave: Good afternoon. I want to call to order the March 20, 2007 meeting of the Board of Commissioners of Vanderburgh County. We will start with introductions on my right.
Marissa Nichoalds: Marissa Nichoalds, Superintendent of County Buildings.
Kathryn Schymik: Kathryn Schymik from the office of the County Attorney.
Bill Nix: Bill Nix, County Commissioner.

Award Bid: VC07-03-01: Kuebler Road Bridge Rehabilitation |
President Musgrave: Is there a motion to award the bid VC07-03-01, the Kuebler Road bridge rehabilitation? Is Mr. Stoll here to tell us who we’re going to award that to?
John Stoll: The low bidder on that project was J.H. Rudolph, and the bid amount was $105,291.40. Everything was okay with their bid. So, I would request that it be awarded to them.
Commissioner Nix: Move approval.

Welcoming of North High School Government Class |
President Musgrave: We move now to our first action item. Before we do, I would like to welcome the senior government class from North High School. Welcome. I understand that you’re just getting in under the wire on your attending a government meeting. I say that you chose a good one, because this one will be very short. Last week it was like an hour and a half. Yeah, so, welcome today.

President Musgrave: The County Commissioners 2007 health services agreement with Welborn Health Plans. This is an ordinary annual contract. Is there a motion to approve?
Commissioner Tornatta: So moved.
Commissioner Nix: Second.

President Musgrave: The motion carries. The 2007 worksite marketing payroll deduction agent/employer service agreement with Cincinnati Life Insurance. Again, this occurs every year. The money is in place. The attorneys have looked at it. Is there a motion to approve?
Commissioner Tornatta: So moved.

President Musgrave: The motion carries. The Matrix Integration engagement proposal for Courts technology project. This is a $50,000 project. The contracts have been reviewed, and the terms of the proposal have been approved by all involved, and the funding is in place. Is there a motion to be approved?
Commissioner Tornatta: So moved.

President Musgrave: We move now to department head reports. Mr. John Stoll, the County Engineer. Mr. Stoll, will you tell us about the award that Vanderburgh County and it’s engineer, American Structure Point, I believe, won as well?
John Stoll: The award was for the Stockwell Road culvert project, where the two 96 inch diameter pipes were bored underneath Norfolk Southern Railroad, plus the new ditch was constructed, and, I believe, it was a 12 foot by 10 foot concrete box culvert was installed underneath Stockwell Road. It was completed, I believe, the fall of 2005, if I remember correctly. It was the consulting engineer’s counsel that gave the award.
President Musgrave: My guess it’s a fairly prestigious award in the state, and American Structure Point was quite honored to receive that. I’m new at the whole award and engineering discussion, but I understand that that was quite an honor. For a Vanderburgh County project to win an award, that’s impressive.
John Stoll: As far as items that I have from my report, the first one is a change order for the Abell Park sanitary sewer project. That was contract number VC06-06-05. It’s for an increase of $10,660.20. The primary reason for that increase was due to some additional asphalt patching that was required to complete the project. You might recall that was the Barrett Law project. So, now that we know the final contract amount, we can proceed with getting to the bond issue, and getting everything wrapped up. But, I would request your approval of the change order.

John Stoll: The other item is also a change order. This is for the Baseline Road culvert number 130 repair project. This was contract number VC06-10-03. It was for an increase of $1,196.47. That had some overruns in asphalt, that’s primarily what caused that to have the overrun.

President Musgrave: Alright. Is Debbie Spalding here? Please come forward. I understand that you have some car wash bidding that needs to be done.
Debbie Spalding: Yes, I wasn’t able to get a hold of Ted Ziemer. So, I’m not sure if he’s had an opportunity to review the agreements.
Kathryn Schymik: I didn’t receive a message or any agreements from him. He is out of town until April.
Debbie Spalding: Okay. What we’re doing is we are looking at getting prices on car washes. The last time this was bid out was in 2000, and the company that offered it before aren’t able to extend that price any longer. So, we do have some price checks on that, and maybe at the next meeting, if I could come back, after he’s had a chance to review the agreements?
President Musgrave: We will not be meeting next week.
Debbie Spalding: Okay.
President Musgrave: So, it will be the meeting after that.
Debbie Spalding: Okay.
President Musgrave: Alright?
Debbie Spalding: Thank you.
President Musgrave: Are there any other department heads who have reports. I see the Health Department, nothing? Okay. Ms. Nichoalds?

Marissa Nichoalds: I just have one request, the Polling Place Advisory Committee is working on establishing the polling precincts for the City election. With your permission I would like to send a letter to the precincts that will be the same as they were in the past. A letter asking for contact information. I would like to get that out this week, if possible.
President Musgrave: You mean the actual location where people will be voting?
Marissa Nichoalds: Correct.
President Musgrave: Okay, is there a motion to approve sending the letter to the–

President Musgrave: Thank you, Ms. Nichoalds. Anyone else? I don’t see anyone.
New Business |
President Musgrave: We have some new business, a proclamation. I thought that Mr. Royce Sutton, Councilman was going to be here, but I don’t see him.
Commissioner Tornatta: He did call, and he said he would be running a little late. So, if we want to move past, or if we want to–
President Musgrave: I’ll take a moment to talk about our visitor to the department head meeting, Mr. Brian Glover, who is the Supervisor of Public Affairs and Safety for CSX Transportation. He gave a very important number that the public will want to know to call about complaints regarding CSX tracks, the crossings at tracks, potholes, anything of the above. So, for all the world to know, it’s 1-877-TELLCSX. So, if you have a complaint about a CSX crossing, that’s the number you want to know. Mr. Glover did come to talk to us, excuse me, about some issues that CSX has regarding, what do they call those, sidings, where they allow two trains to pass. Am I getting that correct?
Commissioner Nix: That’s correct.
President Musgrave: He was suggesting, just for the public’s knowledge, that they might be asking the Commissioners to close Stacer Road. The Commissioners offered several options to that, and Mr. Glover is going to take those suggestions back, and he will be in contact with us. Mr. Tornatta is taking the lead on those discussions, but any of the Commissioners would be pleased to take your calls regarding CSX’s plans. There is nothing final at this time. We will keep you updated as that progresses.
Commissioner Tornatta: Just to clarify, our options were to not close Stacer Road, and to try and keep that open. So, CSX has several ways that they can go about doing business, but one of the ways that we’re trying to work with CSX is to get some type of conversation points so that we both have an understanding of direction that we want to take. So, that’s one of the issues we brought to Brian. He’s going to take that back to his up line, and, hopefully, we’ll be able to come to some consensus.

Line Street Church of Christ Day Proclamation |
President Musgrave: So, Mr. Tornatta, do you want to go ahead and read the proclamation, since Mr. Sutton has been delayed?
Commissioner Tornatta: I do have that. This is for the proclamation of the Line Street Church of Christ Day, Nov, I’m sorry, March 24, 2007.
“Whereas, the Line Street Church of Christ has dutifully served this community since 1927 and is one of the oldest churches in the central city of Evansville, Indiana, and; Whereas, the Line Street Church of Christ has answered the call to provide needed services and programs that meet the temporal and spiritual needs of many residents of our community, and; Whereas, the Line Street Church of Christ is a vital neighborhood based link between the residents in the surrounding neighborhoods and key services like child care and after school tutoring, and; Whereas, the Line Street Church of Christ has pledged to be every mindful of their duty to render equal services to all through its planned feeding program and clothes closet for the needy, and; Whereas, the Line Street Church of Christ offers an important opportunity to spread the word to all citizens of Vanderburgh County that they can reshape and influence revitalization efforts in their community, and; Whereas, the Line Street Church of Christ serves as an example of how faith, compassion, vision and commitment produce programs that address needs and enable individuals to excel, and; Whereas, Saturday, March 24, 2007, marks the day that the Line Street Church of Christ dedicates it’s new edifice, the Kelley Campbell Atwater Educational Complex, Now, Therefore be it resolved, that the Board of Commissioners of Vanderburgh County does hereby recognize Saturday, March 24, 2007, as the Line Street Church of Christ Day,”

Commissioner Tornatta: That’s right. And just so I can make sure I get all this;
“And further extend appreciation to the Minister Marcus T. Watkins, and to all the members of the Line Street Church of Christ family for the vital services they perform and their exemplary dedication to the community.”
