The Vanderburgh County Board of Commissioners met in special session this 31st day of July, 2009 at 3:01 p.m. in room 301 of the Civic Center Complex with Vice President Stephen Melcher presiding.

Commissioner Melcher: Okay, let’s go ahead and open up this special meeting of the Vanderburgh County Board of Commissioners, July 31, 2009, room 301 at 3:00 p.m. We’ll show that the people present are Lloyd Winnecke, Commissioner; Steve Melcher, Commissioner; the attorney, Mr. Ziemer; and Auditor, Mr. Fluty; and Recording Secretary, Teri–
Teri Lukeman: Lukeman.
Commissioner Melcher: –Lukeman.
Approval of Right-of-Way Encroachment Agreement: Resurrection School |
Commissioner Melcher: We have one action item. I guess, Ted, do you want to talk about it?
Ted C. Ziemer, Jr.: Yes.
Commissioner Melcher: About the encroachment agreement for the Diocese of Evansville?
Ted C. Ziemer, Jr.: Right. Resurrection School would like to place a flasher light, that’s one of the lights that say 20 miles per hour when flashing, and it runs on solar power, one 500 feet east of the school, and one 500 feet west of the school, with both locations being in the right-of-way for New Harmony Road. They have presented the county with a right-of-way encroachment agreement, which is satisfactory as to form, so far as the County Attorney is concerned, and a certificate of insurance with the required limits, or coverages. It’s satisfactory for approval should you wish to do so.
Commissioner Winnecke: Mr. Chairman, at this time I would move that we approve the encroachment agreement with the Diocese, with Resurrection School.
Commissioner Melcher: Yes, and I’ll second that agreement also. Do we have any further discussion?
Commissioner Winnecke: Nope, I’m fine with it.
Commissioner Melcher: Mr. Fluty, do you got any?
Bill Fluty: No, I’m fine with it.
Commissioner Melcher: There’s nobody from the audience, but I would just like to say that anyway. With that can we have a roll call vote, please?
Teri Lukeman: Commissioner Winnecke?
Commissioner Winnecke: Yes.
Teri Lukeman: Commissioner Melcher?
Commissioner Melcher: Yes. With that, since we have two here we do have a quorum, so this passes.
(Motion approved 2-0)
Commissioner Melcher: Any other business to come before this special meeting?
Commissioner Winnecke: Mr. President, or Mr. Chairman, I would move for adjournment.
Commissioner Melcher: And I second it. All in favor say aye.
Commissioner Winnecke: Aye.
Commissioner Melcher: Aye. We’re closed.
