The Vanderburgh County Board of Commissioners met in session this 12th day of April at 5:35 p.m. in the Commissioners' Hearing Room of the Civic Center Complex with Vice President Richard E. Mourdock presiding.
 
Introductions and Pledge of Allegiance

Commissioner Mourdock: Okay, we will call the meeting of April 12, 1999 of the Vanderburgh County Commissioners to order. And by way of introductions, although I think probably everyone here knows everyone, just for the record we have Tony Greubel, Joe Harrison, Jr., Commissioner Tuley, Charlene Timmons, Suzanne Crouch and myself. Bettye Lou Jerrel is Indianapolis this evening doing some county business. Doing some arm twisting at the Legislature I suspect. Please join us for the Pledge of Allegiance.
 
Approval of minutes

Commissioner Mourdock: The first thing on our agenda is the approval of the minutes from last week, but since I was ill last week Bettye Lou and Pat have to do those jointly, so we'll set those aside until next week.
 
Open bids - Title search services

Commissioner Mourdock: The first thing then is opening bids with title search services and repairing and repaving some various roads. Information on that, Tony, or Bill Cottun? I'm sorry, I misread my notes.

Joe Harrison, Jr.: It looks like we just have one bid. Is that correct, Tony, that came in on the title search services? So if there is a motion for me to open and read that aloud in the minutes I'll do that.

Commissioner Tuley: I'll so move.

Commissioner Mourdock: I will second and say so ordered. We can come back to that one then.

Joe Harrison, Jr.: What about the second one, repair and repaving of various county roads?

Tony Greubel: I never received anything.

Commissioner Mourdock: Did not receive--

Charlene Timmons: John would probably have those.

Commissioner Tuley: It will probably be under John's report when he gets here.

Joe Harrison, Jr.: Yeah, we can probably wait. 

Charlene Timmons: I don't think he is here yet.

Commissioner Mourdock: Okay, well, we'll come back to that then as soon as John gets here.
 
Ogden Entertainment - Contract for The Centre

Commissioner Mourdock: Okay, Item 3 is the contract with Ogden Entertainment. Joe, you've given that to us for review in our packet. 

Joe Harrison, Jr.: The contract that we've been working on for the last several months is in front of you. It has been signed by Ogden. Sandie Aaron of Ogden Entertainment is here tonight to answer any questions that the Commissioners may have with respect to what their plans may be. The term of the agreement is a term of 48 months running from...it's going back from February 1st of 1999 through midnight of January 31, 2003. Ogden has been acting as agent for booking purposes and contractual agreements that they may have entered into on behalf of the county with respect to any of the rooms over there for the last two months or so. The compensation part of the contract is listed on page 13 of the agreement, it would be Article 5, just for your review. It also includes an incentive fee as well. Again, we have worked out the terms. You all...it essentially was the same draft that we've been working on for the last several months, but there were some things that finally had to get worked out and I believe it is presentable for approval this evening. Ogden is...again, they have signed it and they are ready to get going. 

Commissioner Mourdock: Any questions for Sandie?

Commissioner Tuley: Just page 8, beginning with about the county employees, the five previous county employees.

Joe Harrison, Jr.: Yes, yes. What questions do you have?

Commissioner Tuley: I just want to make sure I understand the wording. When it gets down there it says:

...shall if specifically requested. Joe Harrison, Jr.: Oh, as far as--

Commissioner Tuley: Two of them have other jobs, let's say, and they don't want to go to work is that what we're dealing with here? 

Joe Harrison, Jr.: It is my understanding the intent of the contract is to have five either employees, county employees that were working over there before continue to work. It's either employees that were working or they may be new employees. It's positions, so there is going to be five positions whether they are the same five people, that will remain to be seen whether they want to come back or not.

Commissioner Tuley: Okay. 

Joe Harrison, Jr.: But if they don't it will be five positions.

Sandie Aaron: I think more than anything that is just to clarify that should the county desire to bring more employees in we didn't want to be held accountable for the incentive calculate, for them to be included in the incentive calculate.

Commissioner Tuley: Other than the original five?

Joe Harrison, Jr.: Yes.

Sandie Aaron: Right. 

Commissioner Tuley: Okay. 

Joe Harrison, Jr.: And Sandie and I are going to be meeting with the union business agent later this week, Chuck Whobrey, regarding that.

Sandie Aaron: I would tell you, too, that we really have hit the ground running and I literally have had a half dozen instances already where we literally did not have a room available to rent on specific days.

Commissioner Mourdock: Really?

Sandie Aaron: So it's really, really energizing. It really is.

Commissioner Mourdock: Good.

Sandie Aaron: Trade shows, we are just getting a huge response. We've begun to work on the grand opening. Now the next concern is where am I going to put it, so that's a nice problem.

Commissioner Mourdock: Yep, very good. 

Commissioner Tuley: That's good news to start with.

Commissioner Mourdock: Yes, it is. Yes, it is. We're all looking forward to the ribbon cutting.

Sandie Aaron: We are, too.

Commissioner Mourdock: I haven't done one of those since I have been on this Board.

Commissioner Tuley: You're going to do that one!

Commissioner Mourdock: But I will do that one, yeah. Okay, is there a motion then for approval of the management agreement with Ogden?

Commissioner Tuley: I will so move at this time.

Commissioner Mourdock: And I will second and say so ordered and look forward to working with you, Sandie.

Commissioner Tuley: Yes, we do.

Sandie Aaron: Thank you very much.

Commissioner Mourdock: Okay. Fill that building. 
 
Bill Cottun - PDS maintenance agreement

Commissioner Mourdock: Okay, now Bill Cottun with a contract for us to review.

Bill Cottun: I bring a request before you today for approval of a maintenance agreement between the city and county and Personnel Data Systems or PDS. The agreement is for $16,335. The city cost is $8,167.50. The county cost is the same. The agreement provides for software support, maintenance and version upgrade if issued this year for the payroll manager, the personnel manager, information manager and security manager for the DEC/VAX version, which is our mainframe version. The contract expires December 31 and the agreement does represent a ten percent increase in cost over the 1998 agreement. I would like to bring one item up for the Commissions' consideration. PDS is currently issuing a new software product to replace their mainframe product. It's a client server product. It is my opinion that PDS is going to escalate their maintenance agreements on their DEC/VAX possibly considerably over the next year or two. They want people to migrate from mainframe to client server, so there is a good possibility that there will be even a larger increase next year. I know the dollar amount isn't significant. It's more an issue of procedure and policy. They do want people moved to client server. I do see the possibility of them discontinuing support for this product in the next two or three years which would almost force a move to client server. I just give that as a caution as we negotiate for the contract next year.

Commissioner Mourdock: That raises the question then would we be better served instead of having this be an agreement that expires 12/31 of this year have it be a more multi year agreement to make sure we have service?

Bill Cottun: We have tried to address that a couple of times, each time PDS has substantially raised the cost of the agreement. They're really not wanting to be tied into a long-term agreement right now to their client server. I know we tried that last year and this year. So I think the only thing we're going to get out of them is year to year until they decide that they don't want to support their mainframe product any more. They have not given anything in writing and have not specifically stated this. This is more a trend that is occurring in the market right now. As a company moves to a client server product they want to release resources that are supporting their mainframe product. 

Commissioner Mourdock: Okay.

Commissioner Tuley: Well, given that information I don't see where we have a whole lot of choice, so at this time I'll move for approval of the maintenance agreement with PDS in the amount of $8,167.50 on behalf of the county.

Commissioner Mourdock: And I will second and say so ordered.

Bill Cottun: Thank you very much.

Commissioner Mourdock: Okay, thanks, Bill. Okay, just to clarify something from our agenda and now that John Stoll has arrived, the line item that we had on our agenda which was for the title search services and repair and repaving of various county roads that road section of that is to be placed on the agenda April 26th. Is that correct, Charlene?

Charlene Timmons: Yes.

Commissioner Mourdock: So that did not belong on there this evening. It is April 26th.

Commissioner Tuley: This repair?

Commissioner Mourdock: Yes. 

Commissioner Tuley: Title search only is what you're saying is what we're doing?

Commissioner Mourdock: Yeah. So the road section comes off until April 26th. Thank you for catching that, Charlene.
 
Any group or individual wishing to address the Commission

Commissioner Mourdock: Okay, any group or individual wishing to address the Board then this evening? Mr. Jones. I may have just answered your issue there with the rescheduling of that, I don't know.

Jerry Jones: Yes, I didn't know if you wanted a copy of one of the bids, John, I got from...my brother got it. 

Commissioner Mourdock: Sure, we'll take a copy of it. 

Jerry Jones: Bettye wants these.

Commissioner Mourdock: Alright, thank you.

Jerry Jones: April...?

Commissioner Tuley: Twenty-six, yeah.

Commissioner Mourdock: It will be two weeks from tonight.

Commissioner Tuley: Yeah. 

Commissioner Mourdock: Okay, department head reports, John Stoll.

Commissioner Tuley: Richard--

Commissioner Mourdock: Oh, I'm sorry.

Commissioner Tuley: Joe said we might just want to not use the word bid, but just say that this was an estimate. 

Commissioner Mourdock: Right. Mr. Jones provided us an estimate that he had solicited for some fill material along Lyle Road, so we'll enter that into the record and make sure Bettye Lou Jerrel gets a copy of that as well.
 
John Stoll - County Engineer

Commissioner Mourdock: Okay, now John.

John Stoll: First I would like to recommend that we award contract number VC99-04-02, the No. 3 School Road culvert replacement, to Deig Bros. in the amount of $48,987.20. They were the low bidder on the project.

Commissioner Mourdock: Okay. 

Commissioner Tuley: I'll move approval based on John's recommendation.

Commissioner Mourdock: And I will second and so order.

John Stoll: The second item is a change order for the Heckel Road Bridge project. This is for an increase of $40,507.86. This is to cover additional repairs to three end posts that were found to be bad once there was some demolition work done on the bridge project. Those total $28,348.86 and then we had three other additional extra work, new items, that were encountered. One, the concrete caps on the abutments both needed replaced. We had some additional steel repairs that were encountered, they were vertical hangers. There were three of those for $1,320 each and then we had some I-beam hanger bars, and eight of those were bad for $425 each. It's recommended that this be approved. There shouldn't be any more overruns of steel repairs because basically all the demolition work has been completed that has to be done and all the steel has been inspected. We had Beam Longest & Neff down to help us do some additional inspection work on the bridge and they felt that this should take care of all the repairs that are needed to help give this bridge a 20 year life span.

Commissioner Mourdock: Okay, is there a motion to approve the change order?

Commissioner Tuley: So moved as requested and recommended by the Engineer.

Commissioner Mourdock: I will second and say so ordered.

John Stoll: There will be some riprap we have to place out there which would come back as a change order, but no more steel repairs that we know of. 

Commissioner Mourdock: Okay.

John Stoll: And that's all I have unless you've got any questions.

Commissioner Tuley: I think, so there is no misunderstanding, next Monday night is the night we're supposed to make the final approval on road repaving and what have you.

John Stoll: Right.

Commissioner Tuley: It's not the 26th, it's next week. Just so there is no misunderstanding on it. The actual contracts that will be let on some paving that we're going to contract, that will be the 26th, but next week will be the approval. Okay?

Commissioner Mourdock: Okay, let me make sure everybody is clear. Charlene, did you catch that also? The note that you gave me, April 26th is for the repair and repaving of various roads, but the actual road hearing is set for the 19th.

Joe Harrison, Jr.: That's the list.

Commissioner Tuley: The list, the approval of the list I think will actually be next week, the 19th.

Commissioner Mourdock: The 19th, okay.

John Stoll: Right. 

Commissioner Mourdock: Okay, sorry for the confusion, Mr. Jones, the 19th. Okay, thank you, John. 
 
County Garage

Commissioner Mourdock: We have in the packets the County Highway report, the Ozone Officer's report.
 
Steve Craig - Burdette Park

Commissioner Mourdock: We have Steve Craig with Burdette. Steve.

Steve Craig: Outside the report I guess the only thing I needed to talk to you about was the proposed rate hikes that we had turned in several weeks ago. I don't know if everybody has had a chance to review them and if they had any questions I had told, you know, to give me a call.

Commissioner Mourdock: I thought we acted on it. I think we acted on them last week.

Steve Craig: I wasn't here last week.

Commissioner Tuley: I think we did act on them.

Commissioner Mourdock: It was two weeks ago--

Commissioner Tuley: No, it was two weeks ago--

Commissioner Mourdock: --because I was here.

Commissioner Tuley: --because you were here.

Commissioner Mourdock: Yeah, we did act on them as they were submitted.

Commissioner Tuley: Accept them as they were submitted.

Steve Craig: Accepted as they were? Okay. That's all I had.

Commissioner Mourdock: Okay, you're off the hook for this evening. 

Steve Craig: Thanks.

Commissioner Tuley: If you had realized that you wouldn't have had to come down here would you?

Steve Craig: No, I didn't. I guess I didn't get the...I didn't read the minutes from the week I wasn't here.

Commissioner Mourdock: Yeah, we did accept them.

Steve Craig: Okay, that's all.
 
Joe Harrison, Jr. - County Attorney

Commissioner Mourdock: Okay, County Attorney. Joe, do you have a bid to read?

Joe Harrison, Jr.: Yes. This would be the title search services relating to it looks like tax sale...upcoming tax sale. The only bid came in from:

It says for the entire amount of tax sale jobs available and it says 51, so it looks as if there are 51 title searches that they would be performing at the rate of $225 per tax code. You might want to take this under advisement just to see how it...to see if this is the amount...see if you have sufficient funds available for this. 

Suzanne Crouch: There are 44 properties and there are sufficient funds.

Joe Harrison, Jr.: Okay, well then you might want to go ahead and do it if you want to look at it for a second. We've got time probably. So that would be sufficient funds.

Commissioner Tuley: You've done...have they done work for you before? 

Suzanne Crouch: (Inaudible.)

Commissioner Tuley: Yeah, it is usually Schroeder. Yeah, Jack.

Commissioner Mourdock: Evansville Title.

Suzanne Crouch: Maybe we ought to take it under advisement.

Commissioner Tuley: Yeah, why don't you take a look at it. I'll move that it be handed to the Auditor to take under advisement for a week.

Commissioner Mourdock: Okay, I will say second and so ordered. Anything else, Joe?

Commissioner Mourdock: Okay, Superintendent of County Buildings.

Weekly reports

Commissioner Mourdock: Okay, I think I mentioned we have the Ozone Officer report and Solid Waste...or Soil & Water Conservation.

Commissioner Tuley: I'll move the reports be accepted into the record.

Consent items

Commissioner Mourdock: We have consent items that include employment changes, travel requests, the County Auditor's monthly financial, cash and expenditure reports. The Auditor's accounts payable vouchers. The Auditor's release of Old State Barrett Law liens and the Cooperative Extension Service declaring some equipment surplus. Is there a motion to approve the consent items as filed?

Commissioner Tuley: There is with one change. The County Auditor pointed out to me in their request that was listed as B.J. Farrell and Karen Joest to do the traveling there has been a change and the change was after this was submitted to us, so it should be Bill Fluty and Karen Joest.

Commissioner Mourdock: Okay.

Commissioner Tuley: With that change I'll move approval of the consent items.

Commissioner Mourdock: And with that change I will say second and so ordered.

Commissioner Mourdock: Old business before the Board this evening?

Commissioner Tuley: None for me.
 
New business

Commissioner Mourdock: Any new business?

Commissioner Tuley: That's what came out of that Solid Waste meeting.

Joe Harrison, Jr.: Oh. That's fine. I didn't know that they had something. I suggested that they get something prepared. This is good. 

Commissioner Tuley: I think Marco had a chance to read it too, didn't he?

Commissioner Mourdock: Yeah, Marco did it. 

Commissioner Tuley: Okay, then I will move for approval of the agreement between Vanderburgh County Solid Waste Management District and this Board in reference to a grant of $85,000 for the cleanup of the Futrell property.

Commissioner Mourdock: Okay, and I will second and so order. Any other new business to come before us this evening?

Commissioner Tuley: That's all my business unless you've got something.

Joe Harrison, Jr.: Richard, did you want to do anything this evening or do you want to wait a week regarding the Economic Development Council?

Commissioner Mourdock: The meeting on Thursday? 

Joe Harrison, Jr.: Whether we wanted to participate in that effort.

Commissioner Mourdock: Yeah. In fact, we said we would do it in two weeks, but we can go ahead and do that this evening.

Joe Harrison, Jr.: Oh, was it? 

Commissioner Mourdock: Yeah. Just a summary because I know Pat was not there that evening, but we had a very good turnout of the Commissioners from the surrounding counties. Each county was asked to come back by a week from tonight and decide whether or not they wish to participate in the joint economic development plan. If a committee chooses...or if a county chooses to participate then the County Executive from each county will need to appoint as many as ten members to a Board. That Board will serve as a steering committee to try to determine what projects or what areas ought to be marketed, if you will. Currently through the state funding for this region there could be somewhere in the range of $35,000 to $40,000 that would be used. The group, IEDC, which is a not for profit group but it is also a non governmental group, has been contracted with by the Department of Commerce to basically act as facilitators for that group of people that make up the steering committee to try to see what joint assets there are and what joint things can be marketed. The Commissioners that evening were specifically asked to jump in, if you will, and each of them...each county wanted to go back and talk at their own meeting about it. I know Bettye Lou, I think, was very supportive. I certainly feel very good about their efforts. My only concern was how effective they can be with a steering committee with as many as 40 people. 

Commissioner Tuley: Did we establish guidelines as to the makeup of that?

Commissioner Mourdock: The guidelines are pretty well already in the program.

Commissioner Tuley: Okay.

Commissioner Mourdock: As far as who should be chosen, what segments of the county need to come into that.

Commissioner Tuley: Okay.

Commissioner Mourdock: I think we need to be very selective with that though and make sure we get people that are really dedicated to it. It is going to take some time on their part and the goal is that they'll have whatever the product of this thing will be will be done by the end of the year, so it will move fairly quickly.

Commissioner Tuley: So it would be your recommendation that we do join in force with the other counties?

Commissioner Mourdock: The only thing it costs us, if you will, is finding some people who are willing to serve and willing to represent us and I think it is certainly worth the effort because we're going to keep fighting among ourselves when these businesses come through and this may at least not prevent every one--

Commissioner Tuley: It's crazy.

Commissioner Mourdock: --of those skirmishes, but may prevent some of them.

Commissioner Tuley: So the motion you need would be for us to agree to and commit to joining?

Commissioner Mourdock: Right.

Commissioner Tuley: And I will so move.

Commissioner Mourdock: I will second and so order. Tony, if you would please, would you get back to Graham Toft and let him know that?

Tony Greubel: Sure.

Commissioner Mourdock: Okay, any other new business?

Commissioner Tuley: None for me.
